Title claims & rectifications
We have a particular expertise in dealing with specific property issues (which do not easily fit the description of ‘conveyancing’). This may be a dispute involving property, be it an argument over a right of way, a boundary dispute or a claim for professional negligence against either a surveyor or solicitor. Sometimes when a property is sold a title problem is revealed. On occasions this needs to be rectified , other times defective title insurance is the answer. We can advise on the implications of both.
We can assist clients in claims for adverse possession of property , or in defending such a claim. Complex titles can suffer from imprecise documentation which at a later date can cause difficulties – we can look to rectify this. Leasehold properties (especially flats) can cause lots of problems. We have on occasion been asked to provide a second opinion for firms of solicitors / conveyancers where the parties have been unable to agree the best way forward when faced with a difficult property problem.
We can assist with the drafting or approval of Section 106 agreements which developers (even private developers of just one or two units) are usually required to enter into. Similarly we advise on and prepare evidence for applications for certificates of lawfulness.
